This document is the contract between you and Mindlet, the publisher of SpeedPost. It also serves as the End User Licence Agreement (EULA) for the application downloaded from the App Store and Google Play.
We wrote it to be readable. It remains legally binding: please take the time to go through it, in particular section 4 on subscriptions and section 5 on cancellation.
1. Who we are, and what this document covers
SpeedPost is an AI-assisted social media management service published by MINDLET SAS, a French simplified joint-stock company registered in Aléria (Haute-Corse, France). Our full details are on the legal notice page.
These terms apply to:
- the
speedpost.frwebsite; - the
speedpost.fr/appweb application; - the SpeedPost applications for iOS, iPadOS, Android and macOS;
- all paid subscriptions, whatever the purchase channel.
We refer to all of the above as “the Service”.
2. What the Service does
SpeedPost brings together, in a single interface, the management of several social media accounts and an artificial-intelligence agent. The Service lets you:
- connect and manage several social media accounts from one place;
- create, schedule and publish content to several platforms at once;
- generate content (text, images, video) using artificial intelligence;
- define a brand identity and editorial guidelines that the agent follows;
- review your publication statistics and reply to your Google reviews.
The Service is a professional tool. It only publishes what you have requested, scheduled or approved.
3. Acceptance, minimum age and account
3.1 Acceptance
Creating an account, subscribing or simply using the Service constitutes unreserved acceptance of these terms. If you do not accept any provision, do not use the Service.
3.2 Minimum age
You must be at least 16 years old to use the Service. If you use SpeedPost on behalf of a company, association or any other legal entity, you represent that you have authority to bind it.
3.3 Your account
- Creating an account requires a valid email address and a password.
- The information you provide must be accurate and kept up to date.
- You are responsible for keeping your credentials confidential and for any activity carried out from your account.
- A single account gives access to the whole SpeedPost ecosystem: SpeedPost Social (social media publishing), PassWallet (loyalty and lead capture), SpeedCRM (customer relationships) and WebAgentic (websites). There is one sign-up and one password, with a separate subscription per product. These terms apply to each of those services, subject to any specific terms one of them may publish.
- Tell us immediately at contact@speedpost.fr if you suspect unauthorised access.
3.4 Suspension and termination by Mindlet
We may suspend or terminate your access in the event of a serious breach of these terms, in particular unlawful use of the Service, infringement of a third party’s rights, or an attempt to gain unauthorised access to our systems. Except where the law or the seriousness of the facts prevents it, we will notify you beforehand and give you the opportunity to remedy the breach.
4. Auto-renewable subscriptions
This section describes exactly how our paid subscriptions work. It is the most important part of this document.
4.1 The plans
SpeedPost offers three subscription plans, each available on a monthly or yearly basis:
| Plan | Posts | Social accounts | AI credits / month | Automations |
|---|---|---|---|---|
| Flash | 6 / week | 3 | 30 | 2 |
| Boost | 30 / week | 10 | 200 | 5 |
| Turbo | 100 / week | unlimited | 600 | 10 |
One post counts once for all the networks you select. Every plan includes the editorial calendar, scheduling, the media library, brand identity, the conversational AI agent, analytics and Google Business reviews.
The details of each plan, the features provided during the subscription period and the price in force are displayed before any purchase: on the pricing page and on the purchase screen itself. No payment is triggered without that price having been shown to you and confirmed by you.
Each subscription runs for one month or one year, depending on the periodicity chosen, from the date of purchase.
4.2 AI credits
The AI credit is the unit of account for actions that use artificial intelligence: generating text, images or video, rendering a template, drafting an assisted review reply. Your plan’s allowance is topped up every monthly cycle, including on a yearly subscription.
Publishing, scheduling, viewing analytics or managing your media library consumes no credits.
When your balance runs out, no amount is charged automatically: the credit-consuming actions are simply paused until the next top-up, or until you decide to change plan.
4.3 Different prices depending on the purchase channel
Prices shown on speedpost.fr are exclusive of tax, as the Service is aimed
at professionals; applicable VAT is added before payment and appears on your
invoice.
Prices on the App Store and Google Play are shown inclusive of all taxes and may be higher than web prices. This is not an additional margin: the difference covers the commission charged by Apple and Google on every transaction made through their platforms.
The applicable price is always the one displayed on the channel where you subscribe, at the time you subscribe.
4.4 Automatic renewal
All our subscriptions renew automatically. In practice:
- your subscription renews at the end of each period, for an identical period, at the price then in force;
- it renews unless you turn off automatic renewal at least 24 hours before the end of the current period;
- the renewal is charged within the 24 hours preceding the end of the current period.
4.5 Billing by purchase channel
Purchase through the App Store (iOS, iPadOS, macOS). Payment is charged to your Apple account upon confirmation of purchase, then on each renewal. Managing the subscription and turning off automatic renewal is done in your Apple account settings after purchase: Settings > your name > Subscriptions.
Purchase through Google Play (Android). Payment is charged to your Google account upon confirmation of purchase, then on each renewal. Management is done in your Google Play account settings: Play Store > Payments and subscriptions > Subscriptions.
Purchase on the web. Payment is processed by our provider Stripe. The amount is charged to the payment method on file, on subscription and on each renewal. Management and cancellation are handled directly from your SpeedPost account, as described in section 5.
Important note for mobile subscriptions. Where the subscription was purchased through the App Store or Google Play, the payment relationship is between you and Apple or Google. Mindlet has no technical ability to cancel the subscription on your behalf: only the holder of the Apple or Google account can turn off automatic renewal from that account’s settings. We can guide you through it, but we cannot do it for you. Refund requests for those purchases are likewise handled by Apple or Google under their respective terms.
4.6 Free trial
A 14-day free trial is offered on first subscription on the web. Its duration and the price charged at the end of it are shown before you subscribe.
Unless cancelled at least 24 hours before the end of the trial, the subscription starts automatically and the first amount is charged. If you take out a paid subscription before the end of an ongoing trial, any unused portion of the trial is forfeited.
Where a trial or introductory offer is available on the App Store or Google Play, its duration and conditions are those displayed by the platform on the purchase screen, which prevail.
4.7 Price changes
We may change our prices. Any change is notified to you by email at least 30 days before it takes effect, and applies only from the following renewal period. If the new price does not suit you, you may cancel before that date: the original price applies until the end of the current period.
4.8 Notice before renewal (yearly subscriptions)
For yearly subscriptions taken out on the web by a consumer, we notify you by email of the deadline for declining renewal, no earlier than three months and no later than one month before the end of the current period, in accordance with article L215-1 of the French Consumer Code. If that notice does not reach you within that window, you may terminate the contract free of charge at any time from the renewal date.
5. Cancelling your subscription
Cancelling is free and possible at any time.
5.1 Subscription purchased on the web
In accordance with articles L215-1-1 and D215-1 to D215-4 of the French Consumer Code, a cancellation feature is permanently available, free of charge, directly within the Service:
- open your SpeedPost account;
- go to Settings → Subscription;
- click “Cancel your contract”: you reach your billing area, showing your current subscription and its renewal date;
- select the subscription to cancel and confirm;
- a summary shows the date on which the contract will end.
You then receive an email confirming your cancellation and the date it takes effect.
Cancellation takes effect at the end of the period already paid for. You keep access to your plan’s features until that date.
5.2 Subscription purchased on the App Store or Google Play
Cancellation is done from your Apple or Google account settings, following the paths given in section 4.5. As explained above, we cannot trigger it for you.
5.3 Cancelling is not deleting your account
These are two distinct actions:
- Cancelling ends billing. Your account, scheduled posts and media library are kept.
- Deleting your account erases your account and the associated data, irreversibly, across all four products of the ecosystem — the account being single, so is its deletion. The procedure is described on the account deletion page.
Deleting your account does not automatically cancel a subscription purchased through the App Store or Google Play: remember to turn off automatic renewal with the relevant platform before deleting your account.
6. Right of withdrawal
6.1 The principle
If you are a consumer, you have 14 days from the conclusion of the contract to withdraw without giving any reason, in accordance with articles L221-18 et seq. of the French Consumer Code.
To exercise it, simply send us an unambiguous statement at contact@speedpost.fr. Reimbursement is made no later than 14 days after receipt of your request, using the same payment method as the one used for the purchase.
6.2 Its limit for digital content supplied immediately
SpeedPost is digital content supplied without a physical medium, the performance of which begins as soon as you subscribe. Under article L221-28, 13° of the French Consumer Code, the right of withdrawal can no longer be exercised once three conditions are met:
- you gave your express prior consent for performance to begin before the end of the 14-day period;
- you expressly waived your right of withdrawal;
- Mindlet provided you with confirmation of that agreement on a durable medium.
For purchases made through the App Store or Google Play, refund requests follow Apple’s and Google’s procedures.
7. Intellectual property
7.1 What belongs to Mindlet
The Service, its code, interface, design, trade marks, logos and documentation are the exclusive property of MINDLET SAS and are protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable right of use, limited to the term of your subscription.
7.2 What belongs to you
You retain all your rights in the content you create, import or publish through the Service: text, photographs, video, trade marks and visual identity.
7.3 The licence you grant us
So that the Service can work, you grant us a non-exclusive, worldwide, royalty-free licence, limited to what is technically necessary: hosting, storing, reproducing, adapting the format of and transmitting your content to the social networks you have connected, as well as to the providers listed in our privacy policy.
That licence ends when you delete the content concerned or your account. It does not allow us to exploit your content for advertising purposes, to transfer it to third parties, or to train artificial-intelligence models on your content.
8. Acceptable use
When using the Service, you undertake to:
- comply with applicable laws and regulations;
- comply with the terms of the social networks you connect;
- not publish unlawful, defamatory, hateful or misleading content, or content infringing a third party’s rights;
- not use the Service for spam, unsolicited canvassing or abusive automation;
- not publish content on behalf of a third party without their authorisation;
- not attempt to gain unauthorised access to the Service or its systems, or to circumvent your plan’s limits.
You are solely responsible for the content published from your account.
9. Third-party social media accounts
The Service connects to social networks through those platforms’ official interfaces, after your explicit authorisation. You may revoke that authorisation at any time, from SpeedPost or from the platform itself.
These platforms are independent third-party services: their rules, quotas and interfaces may change without notice. Mindlet is not responsible for a platform suspending your account, removing one of your posts, or for the unavailability or modification of their interfaces. We endeavour to adapt the Service promptly when a platform changes.
10. The role of artificial intelligence
The Service uses artificial-intelligence models to draft text, generate images and video, describe media and suggest replies to your reviews.
- Generated content is provided as assistance: we do not guarantee its accuracy, relevance or completeness.
- You remain responsible for checking and validating any content before it is published. A scheduled post is still a post you approved.
- The same model may produce comparable results for similar requests: we therefore give no guarantee of exclusivity over generated content.
- Some platforms require AI-generated or AI-modified content to be disclosed. It is your responsibility to comply with those obligations.
11. Availability, maintenance and liability
We use reasonable efforts to keep the Service available, without being able to guarantee uninterrupted or error-free operation. Interruptions may occur for maintenance, or because of a provider or a third-party platform.
The Service may evolve: features may be added, changed or withdrawn. If a change substantially reduces your plan’s features, you may cancel free of charge.
To the extent permitted by law, Mindlet’s liability is limited to direct and foreseeable damage, and capped at the amount you paid for your subscription during the twelve months preceding the triggering event. Nothing in these terms excludes the statutory guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) or the warranty against hidden defects, which consumers enjoy.
12. Personal data
The processing of your personal data is not described here, so that the information stays up to date in a single place. See our privacy policy: it details the data collected, the purposes, retention periods, our processors and how to exercise your rights.
13. Provisions specific to the App Store
The following provisions apply only to the application downloaded from Apple’s App Store, and prevail over any conflicting provision of these terms.
- Acknowledgement. This contract is concluded between you and MINDLET SAS only, and not with Apple. Mindlet, not Apple, is solely responsible for the application and its content.
- Scope of licence. The licence granted to you is a non-transferable licence to use the application on any Apple-branded product that you own or control, as permitted by the Usage Rules set out in Apple’s Media Services Terms and Conditions. The application may be accessed by other accounts associated with you via Family Sharing.
- Maintenance and support. Mindlet is solely responsible for maintenance and support relating to the application. Apple has no obligation in this respect.
- Warranty. Mindlet is solely responsible for any warranty, express or implied. In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, which may refund the purchase price of the application, if any; to the maximum extent permitted by law, Apple will have no other warranty obligation.
- Product claims. Mindlet, not Apple, is responsible for addressing any claims from you or a third party relating to the application or your possession and use of it, including product liability claims, any claim that the application fails to conform to a legal or regulatory requirement, and claims under consumer protection law.
- Intellectual property. In the event of a third-party claim that the application infringes that party’s intellectual property rights, Mindlet, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.
- Developer contact details. Any question, complaint or request relating to the application may be addressed to MINDLET SAS, Hameau de Cateraggio, Lot Rumana, Entrée Lot 1, 20270 Aléria, France — contact@speedpost.fr, +33 6 98 19 09 18.
- Third-party terms. You undertake to comply with applicable third-party terms when using the application, in particular those of the social networks you connect.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. By accepting them, you acknowledge Apple’s right to enforce them against you as a third-party beneficiary.
14. Changes to these terms
We may amend these terms, in particular to reflect legal or functional changes. Any substantial change is notified to you by email at least 30 days before it takes effect. If it does not suit you, you may cancel your subscription free of charge before that date. Continuing to use the Service after it takes effect constitutes acceptance.
The date of last update appears at the top of this page.
15. Governing law and dispute resolution
15.1 Governing law
These terms are governed by French law. If you reside in another European Union member state, this clause does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence.
15.2 Prior complaint
If you run into difficulty, first contact our support at contact@speedpost.fr. The vast majority of situations are resolved at this stage.
15.3 Cross-border disputes
If the dispute is cross-border within the European Union, the European Consumer Centre France can assist you free of charge.
15.4 Jurisdiction
Failing an amicable settlement, the dispute may be brought before the competent courts. If you are a consumer, you may bring proceedings either before the court of the place where you were living when the contract was concluded, or the court of the place of the harmful event, or the court of MINDLET SAS’s registered office. If you are acting in a professional capacity, exclusive jurisdiction is granted to the courts of MINDLET SAS’s registered office.
16. Miscellaneous
If any provision of these terms is held void or unenforceable, the remaining provisions retain full effect. Mindlet’s failure to rely on a breach does not waive its right to rely on it later. You may not assign your rights under these terms without our written consent.
